All orders placed by customers with Premier Polytunnels Ltd and all sales of goods by Premier Polytunnels Ltd are subject to the Terms and Conditions below.
Premier Polytunnels Ltd reserves the right to alter any of these Terms and Conditions from time to time and any alterations will apply to orders received after that time.
Online orders submitted shall not be deemed accepted by Premier Polytunnels until confirmed by the Premier Polytunnels Order Confirmation notification (e-mail).
Premier Polytunnels reserves the right to alter the price of goods at any time before delivery to reflect any increase in cost to Premier Polytunnels, any change in delivery details or quantities, or any delay caused by the customer.
All online prices are inclusive of VAT.
Payment can be made by any method specified on the Sage Pay Checkout page of our website. Premier Polytunnels will take all reasonable precautions to keep the details of your order and payment secure, but Premier Polytunnels cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
Payment of the total order price, together with the delivery charge, will be debited from the customer's account after the Premier Polytunnels Order Confirmation notification has been sent to the customer, but prior to the goods being delivered.
Where Premier Polytunnels invoices the customer, payment of the invoice is due within 30 days from the date of invoice. Any late payment attracts interest at the rate of 2% per month. After 60 days, customers whose accounts remain unpaid will have their credit facilities suspended and no further goods will be supplied.
Any discount which is offered subject to payment by a specific date may be withdrawn if payment is not received by that date.
Premier Polytunnels endeavour to ensure that all online prices are correct, however errors may occur. In the event of Premier Polytunnels discovering an error in the price of the goods ordered by the customer, Premier Polytunnels will inform the customer as soon as possible and give the customer the option of reconfirming the order at the correct price or cancelling the order.
If the customer's card issuer fails to make any payment of the price or any delivery charge on behalf of the customer, Premier Polytunnels shall be entitled to cancel the order or suspend any further deliveries.
Customers who fail to pay for goods supplied within an agreed timescale will be liable for all costs incurred by Premier Polytunnels, including collection costs and legal costs.
In the case of goods for export, the customer shall be responsible for complying with any legislation or regulations governing the importation of goods into the country of destination and for the payment of any duties on the goods.

Premier Polytunnels make every effort to deliver goods within the estimated timescales, however delays or increased timescales may occur during the busy season.
Premier Polytunnels can estimate a date for delivery of goods, but customers shall understand that it is an estimate. Premier Polytunnels shall not be liable for any loss caused to the customer as a result of failure to deliver by the estimated delivery date or such other date or time as may be subsequently agreed.
Customers must inform Premier Polytunnels if there are any specific instructions with regards to delivery, for example if the delivery address may be difficult for the courier to find. Premier Polytunnels shall not be liable for any loss caused to the customer as a result of failure to provide such instructions.
Customers have the opportunity to inform Premier Polytunnels if they would like the goods to be left with a neighbour or in a secure location, etc. If customers request for goods to be left unsigned for, it is vital that they leave a signed note/message on the outside of the property which the driver can take for the courier/delivery company's records. Premier Polytunnels shall not be liable for any missing items or any defect of the goods arising from wear and tear, wilful damage, or accident due to the customer's request for goods to be left unsigned for.
Premier Polytunnels will endeavour to accommodate any special delivery requests, however customers shall understand that Premier Polytunnels cannot guarantee a specific date or time for delivery. Goods are delivered by a national courier and Premier Polytunnels recommend that customers are at the delivery address for the duration of the day on the day of expected delivery.
Reasonable access for large and heavy goods vehicles must be available for unloading of the goods. If special arrangements need to be made due to inadequate access, Premier Polytunnels must be informed prior to dispatch of the goods and Premier Polytunnels reserve the right to charge the customer any necessary additional delivery costs.
If the customer fails to take delivery of the goods or fails to provide Premier Polytunnels with adequate delivery instructions prior to dispatch of the goods, Premier Polytunnels reserve the right to store the goods until delivery can be made and charge the customer storage costs.
Premier Polytunnels always endeavour to deliver a complete order, however on occasions when items are out of stock, Premier Polytunnels will dispatch these items by the standard delivery method as soon as the items are available. Premier Polytunnels shall not be liable if this causes delay to the customer’s construction of the structure.
Missing Items or Items Damaged in Transit
All parcels must be checked by customers prior to signing the delivery note (unless customers have given special instructions that goods can be left in a secure location unsigned for). If there is any damage to the goods or if items are missing, this must be stated on the delivery note where possible and must reported to Premier Polytunnels within 3-days of the date of delivery. If notification is not made within 3-days of the date of delivery, Premier Polytunnels will not be able to make a claim with the courier/delivery company. Premier Polytunnels shall not be liable for any missing items or any defect of the goods arising from wear and tear, wilful damage, or accident as a result of any request by the customer that goods are to be left unsigned for.
Premier Polytunnels shall make a full refund of the total price of the sale to the customer under the following conditions:
- You must inform us that you wish to return the goods within 14 days of receiving the goods.
- You must return the goods to us within another 14 days.
- The goods must be returned in their original condition (unused) and packaging.
All goods should be returned at the customer's expense.
Premier Polytunnels shall not be liable for any defect of the goods arising from fair wear and tear, wilful damage, accident, negligence, acts of God, use otherwise than as recommended by Premier Polytunnels, failure to follow the manufacturer’s instructions, or any alteration or repair carried out without the approval of Premier Polytunnels.
Customer’s Right to Cancel
If you are a consumer, you have the right to cancel your contract with Premier Polytunnels at any time up to the end of 14 days after you receive the goods. See the Consumer Contracts Regulations 2013.
If you exercise your right to cancel after the goods have been delivered to you, you will be responsible for returning the goods to Premier Polytunnels at the trading address below at your own expense. The goods must be returned in their original condition (unused) and packaging, and with the order number enclosed. You must ensure that goods are not damaged while on your premises or in transit.
Once you have notified Premier Polytunnels that you are cancelling the contract, Premier Polytunnels will refund you as follows:
- Your refund will be made within 14 days from the day on which the goods are received back by Premier Polytunnels from you.
- If the goods have not yet been received by you, your refund will be made within 14 days of you telling Premier Polytunnels that you have changed your mind.
If you do not return the goods as directed, Premier Polytunnels may charge you for the cost of recovering the goods.
Any claim by the customer that goods are defective must be notified to Premier Polytunnels as soon as possible after delivery or, where the defect was not apparent at the time of delivery, within 3-days of discovery of the defect. Claims must be made to Premier Polytunnels in writing and with accompanying photographs. If the customer fails to notify Premier Polytunnels of the claim within a reasonable time period after delivery, the claim will be rejected and Premier Polytunnels shall not be liable for any defect or failure.
Upon receipt of the claim, Premier Polytunnels shall arrange inspection of the goods and if the claim is to be upheld Premier Polytunnels can either arrange for collection and replacement or refund the value of the defective item.
Premier Polytunnels endeavour to ensure all our products are of the highest possible quality, however Premier Polytunnels shall not be liable for any claim that exceeds the value of the defective item or the total invoice value.
Premier Polytunnels shall not be liable for any defect of the goods arising from use otherwise than as recommended by Premier Polytunnels, failure to follow the manufacturer's instructions, or any alteration or repair carried out without the approval of Premier Polytunnels, including goods purchased from Premier Polytunnels for the use in building second-hand polytunnels.
Premier Polytunnels make every effort to advise and assist customers seeking to purchase polytunnel parts or components for the use in building second-hand polytunnels. Premier Polytunnels make every effort to advise customers of the required goods based on the customer's measurements, dimensions, and information provided. Premier Polytunnels shall not be liable for the incorrect goods being purchased by the customer following these discussions. Premier Polytunnels shall not be liable for the cost of replacement goods or delivery charges, including the cost of having goods returned, due to incorrect goods being purchased by customers for the use in building second-hand polytunnels or any polytunnel other than a 'Premier' Polytunnel.

Risk of damage to or loss of the goods passes to the customer at the time of delivery or if the customer wrongfully fails to take delivery of the goods.
The ownership of the goods shall not pass to the customer until Premier Polytunnels has received in full the total order price and delivery charge.
Until such time as the goods passes to the customer (and provided the goods are still in existence and have not been resold), Premier Polytunnels shall be entitled at any time to require the customer to deliver up the goods to Premier Polytunnels. If the customer fails to deliver up the goods, Premier Polytunnels shall be entitled to enter upon any premises of the customer or any third party where the goods are stored and repossess the goods.
The customer shall not be entitled to pledge or in any way charge by way of security for any indebtedness any of the goods which remain the property of Premier Polytunnels. If the customer does so, all monies owing by the customer to Premier Polytunnels shall become due and payable.
Any construction work carried out by Premier Polytunnels Ltd is subject to the Terms and Conditions as stated in writing on official quotations provided to customers. Verbal agreements between Premier Polytunnels and customers for construction work to be carried out are subject to the same Terms and Conditions.
